4. SPECIFIC TERMS AND CONDITIONS OF THE RENTAL AGREEMENT:

4.1 In case of THEFT or serious damage due to MISUSE, the lessee (client) will pay 10% of the value of the bicycle between €2,000 and €3,500 depending on the type of ebike. This 10% amount will be used to cover the all-risk insurance excess that includes the rental of ebikes at MoreraBike. Hereby, the lessee (client), declares himself solvent to face the payment of said economic amount if necessary.

4.2 The lessee will pay the rental amount by credit card, through the MoreraBike website payment platform and the bicycle will be delivered by MoreraBike at the agreed address and time.

4.3 The rental client receives the bicycle in perfect condition for use and clean. Any claim regarding the condition of the bicycle must be formalized at the time of delivery.

4.4 The rental client has the obligation to return the bicycle, including the borrowed accessories, at the time and place previously established and always during the business hours of the collaborating company. The bicycle will be returned in the same conditions of use as at the time of delivery. The loss of components and accessories as well as damage caused by misuse must be transmitted at the time of return and will be billed to the customer.

4.5. Minimum age of the user client. The recommended minimum age to use electric bicycles is 14 years old, except for the companion of the tandem, and adolescents under 18 years of age must be accompanied by an adult and responsible for them with signed permission from parents or guardians, guaranteeing the civil and financial liability.

4.6 Insurance. Each bicycle has an individual insurance that covers the risk of theft and mandatory CR. The insurance fee is included in the rental price. The client confirms with the signing of the contract that he has sufficient economic funds to cover any risk related to the rental of the bicycle with risks not covered by insurance. Failure to comply with the rules of driving the bicycle on public roads is the direct responsibility of the driver of the bicycle. MoreraBike rejects any direct or indirect responsibility in this case.

4.7 The user must be physically fit and have basic knowledge of handling bicycles.

4.8 The use of the helmet is mandatory and in the event of an accident if the helmet is not worn, it will be the sole responsibility of the renter.

4.9 The bicycles have comprehensive insurance with a deductible of 10% of the purchase value to be paid by the user and only in case of theft, with the pertinent police report by the lessee being an essential requirement within a maximum period of 24 hours. hours. Under no circumstances will theft be covered.

4.10 Legislation. MoreraBike and the lessee agree to submit any divergence related to the interpretation or execution of this contract to the competent courts of the Jurisdiction of the city of Barcelona.
